Convictions in Wayne County Common Pleas Court - January 2, 2013 to January 9, 2013

A criminal defendant has to have been sentenced before he or she is considered “convicted” of a criminal offense in the State of Ohio. The Wayne County Common Pleas Court has jurisdiction over felony-level offenses that take place in Wayne County. Below are the convictions that took place in the Wayne County Common Pleas Court from January 2, 2013, through January 9, 2013:

James O. Schmidt – 12-CR-0301 – (F3)  Illegal Assembly or Possession of Chemicals used for the manufacture of Drugs.   Found guilty by Judge Wiest.  Sentenced to 36 months incarceration, 6 mo. OL suspension, court costs.  (F5)  Unlawful Possession of Dangerous Ordnance.  Found guilty by Judge Wiest.  Sentenced to 6 months  incarceration (total of 3 /12 years in prison total.)

Cara D Heilman – 12-CR-0279 – (F5)Trafficking in Cocaine & (F3) Illegal Assembly or Possession of Chemicals used for the Manufacture of Drugs.  Found guilty by Judge Wiest.  Sentenced to 3 years, random drug testing, counseling, 200 hours community service, obtain employment if disability is denied, probation fee, 6 mo. OL suspension.

Richard L. Jones – 11-CR-0327 – Trafficking in Counterfeit Controlled Substances (F5).  Found guilty by Judge Spitler.  Sentenced to 12 months incarceration, concurrent, 12 months suspended.  Community Control for 2 years.   Petty Theft (M1).  Found guilty by Judge Spitler.  Sentenced to 6 months incarceration, concurrent, suspended.  Community Control for 2 years concurrent.

Richard L Jones – 12-CR-0161 – Violating a protection order.  Found guilty by Judge Spitler.  Sentenced to 30 months incarceration, concurrent, suspended.  Community Control for 2 years, no contact with victim.

Donald E. Snell, III – 12-CR-0167 – (M1) Assault – found guilty by Judge Spitler.  Sentenced to 6 months incarceration concurrent.

Darrell E. Miller – 12-CR-0322 – (F5) Trafficking in Cocaine – found guilty by Judge Wiest.  Sentenced to 12 months incarceration, suspended; 1 year Community Control; 6 mo. OL suspension.  Review hearing in 60 days, drug and alcohol assessment, random drug testing, 100 hours community service.

Tayveon M Toles – 11-CR-0093 – (F5) Trafficking – found guilty by Judge Wiest.  Sentenced to 12 months incarceration, suspended.  2 years Community Control, 6 mo. OL suspension.  ISP, obtain employment, drug testing, counseling and 100 hours Community service.  (M1)  Conspiracy to Commit Trafficking – found guilty by Judge Wiest.  Sentenced to  2 years Community Control – 6 mo. operator’s license suspension. 

Tayveon M Toles – 12-CR-0187 – (F5) Trafficking -  found guilty by Judge Wiest.  Sentenced to 12 months incarceration concurrent, suspended; 2 years Community Control sanctions; ISP; ordered to obtain employment; drug testing; counseling; and 100 hours Community service.  (F4) Trafficking - found guilty by Judge Wiest.  Sentenced to 12 months incarceration concurrent, suspended.

Mark C. Remsky – 12-CR-0196 – (M3) Sexual Imposition – found guilty by Judge Wiest.   Tier 1 registration, 30 days in Jail and Court Costs.
