Week of 9/20/21 Criminal Felony Convictions:

A criminal defendant has to have been sentenced before he or she is considered “convicted” of a criminal offense in the State of Ohio. Below are the felony convictions that took place in the Wayne County Common Pleas Court for 9/20/2021 to 9/27/2021:

 

9/20/2021 – Samuel D. Troyer, 16-year-old male from APPLE CREEK – Case No. 2020 CRC-I 000401

Convicted of Rape, F1, in violation of Ohio Revised Code 2907.02(A)(1)(b) and 6 additional counts. Sentenced by Judge Corey E. Spitler to: a term of incarceration of 10 years to Life and Post Release Control in the amount of 5 years. Additionally, the following conditions were imposed: Pay Court Costs / Probation Fees; Sex Offender Registration: III; Wayne County Jail: Serve 154 Days.

 

9/21/2021 – Nadine Lucia Kittle, 23-year-old female from ORRVILLE – Case No. 2021 CRC-I 000044

Convicted of Possession of a Fentanyl-Related Compound, F5, in violation of Ohio Revised Code 2925.11(A). Sentenced by Judge Mark K. Wiest to the following conditions: Credit for time served

 

9/21/2021 – Victoria A. Gabbert, 49-year-old female from WADSWORTH – Case No. 2021 CRC-I 000539

Convicted of Aggravated Possession of Drugs (Methamphetamine), F5, in violation of Ohio Revised Code 2925.11(A) and one additional count. Sentenced by Judge Mark K. Wiest to: a term of incarceration of 3 days, a fine of $375.00 and a driver’s license suspension for 1 year.

 

9/22/2021 – Andrew Robert Moore, 35-year-old male from RITTMAN – Case No. 2021 CRC-I 000131

Convicted of Aggravated Possession of Drugs, F3, in violation of Ohio Revised Code 2925.11(A). Sentenced by Judge Mark K. Wiest to: Community Control sanctions in the amount of 2 years. The judge ordered: Complete treatment at New Day Additionally the following conditions were imposed: Pay Court Costs / Probation Fees; Standard Terms: Obey All Laws & Probation Rules, Follow Directions of Probation Officer; Perform Community Service: 60 Hours; Random Drug Testing; Alcohol / Drug / Mental Health Counseling as Directed by Probation Department; Intensive Supervision Program.

 

9/22/2021 – Andrew Robert Moore, 36-year-old male from RITTMAN – Case No. 2021 CRC-I 000213

Convicted of Possession of Drugs, F5, in violation of Ohio Revised Code 2925.11(A). Sentenced by Judge Mark K. Wiest to: Community Control sanctions in the amount of 2 years. Additionally, the following conditions were imposed: Pay Court Costs / Probation Fees; Standard Terms: Obey All Laws & Probation Rules, Follow Directions of Probation Officer; Perform Community Service: 60 Hours; Random Drug Testing; Alcohol / Drug / Mental Health Counseling as Directed by Probation Department; Intensive

Supervision Program.

 

9/22/2021 – Andrew Robert Moore, 36-year-old male from RITTMAN – Case No. 2021 CRC-I 000402

Convicted of Possession of Drugs, M1, in violation of Ohio Revised Code 2925.11(A). Sentenced by Judge Mark K. Wiest to: Community Control sanctions in the amount of 2 years. Additionally, the following conditions were imposed: Pay Court Costs / Probation Fees; Standard Terms: Obey All Laws & Probation Rules, Follow Directions of Probation Officer; Perform Community Service: 60 Hours; Random Drug Testing; Alcohol / Drug / Mental Health Counseling as Directed by Probation Department; Intensive Supervision Program.

 

9/22/2021 – Anthony W. Card, 42-year-old male from Elyria – Case No. 2020 CRC-I 000288

Convicted of Aggravated Possession of Drugs (Methamphetamine), F3, in violation of Ohio Revised Code 2925.11(A) and one additional count. Sentenced by Judge Mark K. Wiest to: Community Control sanctions in the amount of 2 years. Additionally, the following conditions were imposed: Pay Court Costs / Probation Fees; Standard Terms: Obey All Laws & Probation Rules, Follow Directions of Probation Officer; Random Drug Testing; Alcohol / Drug / Mental Health Counseling as Directed by Probation Department; Intensive Supervision Program; Participate in Cognitive Behavioral Group.

 

9/22/2021 – Donald A. Johnson, 54-year-old male from Navarre – Case No. 2020 CRC-I 000581

Convicted of Improperly Handling Firearms In A Motor Vehicle, F4, in violation of Ohio Revised Code 2923.16(D)(1) and one additional count. Sentenced by Judge Corey E. Spitler to: a term of incarceration of 50 days, Community Control sanctions in the amount of 2 years, a fine of $600.00 and a driver’s license suspension for 2 years. The judge ordered: Complete firearm safety course. SCRAM for minimum of 90 days after release from jail. Additionally, the following conditions were imposed: Pay Court Costs / Probation Fees; Standard Terms: Obey All Laws & Probation Rules, Follow Directions of Probation Officer; Perform Community Service: 50 Hours; Random Drug Testing; Alcohol / Drug / Mental Health Counseling as Directed by Probation Department; Obtain /Maintain Gainful Employment.
